Father fined for disciplining son with bare foot kick

A TOOWOOMBA father who disciplined his eight-year-old son with a kick has been fined $850.

The man, 31, who is not named to protect the identity of his son, pleaded guilty before Toowoomba Magistrates Court yesterday to a charge of common assault.

Police prosecutor Senior Constable Alister Windsor told the court the boy had been misbehaving at a party on April 5 and was told to go to his father who kicked him with his bare foot.

Other people at the party who saw the incident reported it to police, Snr Const. Windsor said.

The man's solicitor Divina DeLeon told the court her client's son had behavioural issues and had been suspended from school twice, including once for punching a teacher.

On this occasion, the boy had been talking inappropriately to young girls prompting her client to discipline him.

Her client had been trying to get his son to have psychiatric counselling, she said.

Her client, who had no previous of such offending, had co-operated with police and entered an early plea of guilty to the charge, Ms DeLeon submitted.

Magistrate Damian Carroll said his initial thoughts on penalty was for a period of probation for the man, but upon hearing from a Probation and Parole officer that that was not available because of the man's work, he opted for a fine.

Mr Carroll ordered that the conviction not be recorded.
